Pickup times are every hour on the hour from 8am-1pm. All equipment rentals need to be back at the 388 landing by 5pm

WAIVER AND RELEASE OF LIABILITY
Stop, Drop & Row – Hosted by Clearview Kayak Rentals

In consideration of being permitted to participate in the Stop, Drop & Row event hosted by Clearview Kayak Rentals (hereafter “the Event”), I, the undersigned participant, acknowledge, appreciate, and agree to the following:

1. Assumption of Risk
I understand that kayaking, paddle boarding, tubing, swimming, and related water-based activities involve inherent risks, including but not limited to injury, illness, drowning, equipment failure, collisions, exposure to wildlife, or other hazards. I voluntarily assume full responsibility for any and all risks, known and unknown, associated with my participation.

2. Release of Liability
I hereby waive, release, and discharge Clearview Kayak Rentals, its owners, officers, employees, volunteers, affiliates, sponsors, and property owners associated with the Event (collectively, the “Released Parties”) from any and all liability, claims, demands, causes of action, or damages arising from or related to my participation, whether caused by the negligence of the Released Parties or otherwise.

3. Indemnification
I agree to indemnify and hold harmless the Released Parties from any and all claims, demands, losses, or liabilities (including attorney’s fees) arising out of my participation in the Event.

4. Medical Consent and Acknowledgment
I affirm that I am physically fit and capable of participating. I authorize emergency medical care if necessary. I understand that medical services may not be immediately available, and I assume all responsibility for my health and well-being during the Event.

5. Rules and Conduct
I agree to follow all posted rules and instructions from Event staff. I will conduct myself in a safe, respectful manner and will not endanger myself or others.

6. Jurisdiction and Venue
This agreement shall be governed by the laws of the State of Florida. Any disputes arising from this waiver or participation in the Event shall be brought exclusively in a court of competent jurisdiction located in Bay County, Florida. If any party brings suit and loses, the losing party agrees to pay all legal fees and costs incurred by the prevailing party.

7. Severability
If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

8. Media Release
I hereby authorize Clearview Kayak Rentals to use photographs, video, or audio recordings taken of me during the Event for promotional, advertising, or educational purposes, in the sole discretion of Clearview Kayak Rentals. I waive any right to inspect or approve the final use and understand that no compensation will be provided.

WAIVER OF JURY TRIAL: THE PARTIES HERETO HEREBY IRREVOCABLY WAIVE ALL RIGHTS TO TRIAL BY JURY IN ANY ACTION, PROCEEDING, CLAIM, OR COUNTERCLAIM, WHETHER IN CONTRACT OR IN TORT, AT LAW OR IN EQUITY, ARISING OUT OF OR IN ANY WAY RELATED TO THIS AGREEMENT.
